Terms of Service

In one paragraph
By creating an account you agree to use EverywhereX for personal, non-commercial educational purposes, on behalf of a child in your care, or as a teacher on behalf of a school that has licensed the service. You agree not to share accounts, not to try to extract the underlying AI models, and to accept that AI responses are a teaching aid — not a substitute for a qualified specialist. We can suspend accounts that break these rules. If things go wrong, our liability is capped at the fees you paid us in the previous twelve months.
1. Who these terms are between
These terms form a contract between you (the account holder) and EverywhereX, an initiative of 1 in 10 Dyslexia (see 1in10.co.uk), a UK charity registered in England & Wales. Where a school or local authority has signed a separate service agreement with us, that agreement takes precedence over these general terms for pupils and staff covered by it.
“The service” means the EverywhereX web application, the AI tutor, the learning plans, the content library sourced from Oak National Academy, and any associated email communications.
2. Who can use the service
You must be at least 18 years old and legally able to enter into a contract to hold an EverywhereX account. Children under 18 may use the service only under the supervision of an account-holding parent, guardian, or teacher. We do not create accounts directly for children under 13, in line with Article 8 of the UK GDPR.
If you are creating an account on behalf of a school, trust, or local authority, you confirm you have the authority to bind that organisation to these terms.
3. Pilot access and future subscriptions
EverywhereX is currently in closed pilot. Pilot families have free access for the duration of the pilot. No payment details are required during the pilot.
After the pilot exits, paid plans will launch with monthly and annual billing options. Pricing displayed on the landing page is indicative and may change before public launch. Pilot accounts will not be auto-converted to a paid plan without explicit consent — we’ll contact you before any change to your billing status, with at least 30 days’ notice.
When paid plans launch, subscriptions will be billed monthly or annually in advance and renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. UK VAT will be included in all advertised prices where applicable. We do not offer pro-rata refunds for partial periods, except where required by UK consumer law (Consumer Rights Act 2015).
3a. Voice tutor, audio, and Immersive Reader
The service includes a voice tutor (real-time voice conversation with the AI tutor via WebRTC) and the Microsoft Immersive Reader (text-to-speech and accessibility overlay on lessons).
Voice tutor sessions are capped at 30 minutes each and 5 sessions per day per child by default. The voice tutor uses OpenAI’s Realtime API; audio is processed for inference and is not retained by OpenAI to train models. Audio is not stored by us by default — transcript persistence is opt-in per child via Settings → Data & Privacy. Audio recording is not yet available; when it ships, it will be opt-in and subject to a separate consent text.
Immersive Reader sends only the lesson text (no personal data about your child) to Microsoft Azure for accessibility rendering.
3b. SEND profile generation
You may generate an EHCP-shaped SEND Profile for your child via the parent dashboard. This document is not a statutory EHCP — it is a parent-led working document, generated by AI from the intake data and persona you have provided, intended to help you prepare for conversations with your SENDCo or Local Authority. The document is delivered directly to you for download and is not stored on our servers.
4. Acceptable use
By using the service, you agree that you will not:
- Share your account credentials with anyone outside your household, class, or authorised teaching team.
- Use the AI tutor to generate content that is unlawful, harmful, defamatory, obscene, or infringes another person’s rights.
- Attempt to jailbreak, prompt-inject, or otherwise circumvent the moderation and safety systems.
- Reverse engineer, scrape, or systematically download content from the service.
- Use any output from the AI tutor to train another AI model.
- Use the service to impersonate another person or misrepresent your affiliation with any organisation.
- Interfere with the integrity of the service, introduce malware, or probe its security without authorisation.
Serious or repeated breaches of this section may result in immediate suspension of the account, with data retained long enough to complete any safeguarding or legal process, and then erased.
5. Your content and your child's work
You and your child retain ownership of anything you enter into the service — intake answers, chat messages, quiz attempts, notes. You grant us a limited licence to store and process that content solely to provide the service to you, as described in the Privacy Policy.
6. AI outputs — the important caveat
EverywhereX uses large language models from OpenAI to personalise learning plans, generate practice content, and power the AI tutor chat. AI output is generated probabilistically and can occasionally be wrong, incomplete, or inconsistent. You understand and accept that:
- AI responses are a teaching aid, not a substitute for a qualified SEND specialist, educational psychologist, medical professional, or your child’s teacher.
- Learning plans are suggestions. Parents and teachers should review them before setting work.
- The moderation system is strong but not perfect. Please report any problematic response via the contact form so we can investigate.
- You should never rely on the AI tutor for urgent wellbeing or safety matters — it is not a crisis service.
7. Curriculum content
Lesson content is sourced from Oak National Academy and is used under the Open Government Licence v3.0. Oak National Academy is not affiliated with EverywhereX and is not responsible for any modifications, adaptations, or AI commentary we layer on top of that content.
8. Availability
We aim for high availability but cannot guarantee the service will be uninterrupted. Scheduled maintenance will be announced in advance where practical. We are not liable for outages caused by our upstream providers, network failures outside our control, or force majeure.
9. Termination
You can close your account at any time from Settings → Data & Privacy. Deletion is scheduled 14 days ahead so you can cancel if you change your mind. After that the account and all linked child data are permanently removed, subject to the retention exceptions in the privacy policy.
We may suspend or terminate an account immediately if you breach these terms, if continued service would expose us to legal risk, or if a safeguarding concern requires it. Where practical we will give notice first.
10. Liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law.
Subject to that, our total liability to you for any claim arising out of or in connection with the service is limited to the greater of (a) the fees you paid to us in the twelve months before the claim arose, or (b) £100. We are not liable for indirect or consequential losses, loss of profits, or loss of goodwill.
You have statutory rights under UK consumer law (including the Consumer Rights Act 2015) which these terms do not restrict.
11. Changes to these terms
We may update these terms from time to time. If a change is material — for example, a new restriction on how you can use the service — we will email registered account holders at least 14 days before it takes effect. Continuing to use the service after that point is your acceptance of the updated terms. If you don’t accept the change, you can close your account.
12. Governing law
These terms are governed by the laws of England and Wales. Disputes will be dealt with by the courts of England and Wales, without prejudice to any mandatory consumer-protection rights you may have in your place of residence within the UK.
